Intellectual Property

In 2021, the intellectual property professionals in Brazil celebrated the 25th of the Brazilian industrial property law (Law n° 9,279/96). This law was created to adapt the Brazilian IP system to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), substituting the old and outdated industrial property code of 1971, which was enacted during the military period. By updating the Brazilian IP system, such legislation redirected the course of the subject on national grounds, reinforcing and challenging the legal exercise of the matter.

THE EVOLUTION OF INTELLECTUAL PROPERTY IN BRAZIL

Much has happened during the last decades regarding the Brazilian intellectual property battlefield, both in the National Congress and in the Courts of Justice. Important governmental policies and precedents have come into play, both to reinforce and to challenge intellectual property rights.

Aiming to provide an overview, a score was given for each intellectual property milestone since 1996, generating the following chart.

The above chart represents the unfolding of intellectual property and is constantly being updated, considering that solutions for the protection of new assets are proposed organically, as the need of regulating new technologies and creations emerge.
